SmartWay Portal — LEAD EMPREENDIMENTO DIGITAIS LTDA
By accessing the platform, an authorized user acknowledges these Terms and the Privacy Policy.
1. Identification
SmartWay Portal is operated by LEAD EMPREENDIMENTO DIGITAIS LTDA, a Brazilian limited liability company and Small Business (EPP), registered under CNPJ 51.340.668/0001-19, with its office at Rua Mistral, No. 332, Edifício The Point, Room 209A, Despraiado, Cuiabá – MT, ZIP 78048-222, Brazil. 2. Purpose and current status
The platform supports digital advertising activities through authenticated access. The current version connects authorized accounts through OAuth, retrieves accounts, campaigns and ad groups, displays integrated metrics, exports information, records operations, and performs controlled pauses. Some resources are available only through authenticated backend endpoints and do not have a complete interface. Audience tools, a media library, visual pixel and catalog management, and visual ad creation remain planned.
The integration is being prepared for an application to TikTok API for Business. These Terms do not represent TikTok approval, certification, endorsement, or partnership.
3. Eligibility and access
Current access is restricted to the administrator appointed by the company, and there is no public registration. Credentials are personal, must not be shared, and must be protected against unauthorized access. The company may allow operators or client accounts in the future only after establishing authorization, responsibilities, access segregation, and other necessary controls.
4. Authorized advertising accounts
Users may connect or operate only accounts owned by the company or for which they hold valid, express authorization from the owner. Users must not bypass permissions, access third-party accounts without authorization, artificially expand granted scopes, or use data for an incompatible purpose. Users are responsible for the legitimacy of their instructions and information.
5. Integrations and permissions
Available functions depend on app approval, permissions granted by TikTok, account authorization, usage limits, and availability of third-party services. SmartWay Portal will request only access categories needed for functions actually used. Granting a permission does not require the platform to provide every technically possible feature.
6. Advertising operations
Users must review the account, object, budget, period, and impact before confirming an action. Creations made through backend endpoints start disabled but still require validation. An uncertain result must not be submitted again before checking it with the provider. Automatic mode, when available on persistent infrastructure, requires explicit activation and a prior simulation; authorized operators remain responsible for commercial decisions and outcomes.
7. Acceptable use
Users must not use the platform for unlawful, fraudulent, or deceptive activity; violate third-party rights or integrated-platform policies; introduce malicious code; test vulnerabilities without authorization; interfere with service availability; extract data in bulk outside the authorized purpose; share tokens; or attempt to access other environments.
8. Security and incidents
Users must protect credentials and devices, close unused sessions, and promptly report suspected compromise to contact@smartwayportal.com. The company may suspend connections or access to contain risk, investigate incompatible activity, or comply with legal obligations.
9. Personal data
Data processing is governed by the Privacy Policy. When connecting a third-party account, the user represents that an appropriate legal basis and authorization exist for instructions given to the platform.
10. Availability and third parties
Availability may be affected by maintenance, network failures, API limits, third-party changes, app review, or events outside the company's reasonable control. TikTok, UTMiFy, and infrastructure providers are independent services governed by their own terms. The company does not guarantee app approval, grant of permissions, endpoint continuity, or advertising results.
11. Intellectual property
The SmartWay Portal brand, code, interface, and proprietary materials are protected to the extent provided by law. Third-party trademarks and content belong to their respective owners. No provision transfers rights beyond the limited authorization to use the workspace.
12. Limitation of liability
To the extent permitted by law, the company is not liable for advertising decisions made by users, third-party service unavailability or changes, unauthorized use of credentials, incorrect data supplied by users, or indirect damage not caused by conduct attributable to the company. Nothing in these Terms excludes liability that cannot legally be limited or mandatory rights under Brazilian law.
13. Suspension and termination
Access may be suspended or terminated upon request, security risk, loss of authorization, violation of these Terms, legal order, or discontinuation. Termination does not remove obligations or records that must legally be retained. Requests may be sent to contact@smartwayportal.com.
14. Changes, law, and contact
These Terms may be updated to reflect technical, legal, or operational changes, with the effective date published here. Brazilian law applies. Disputes will be submitted to the competent venue under mandatory legal rules. Questions: contact@smartwayportal.com.
